These terms form the agreement between you and Pace Sports Performance Inc. for use of pace.fit, the Athlete Performance Portal, and our testing, monitoring, reporting and programming services.
Acceptance of these terms
By using this site, creating an account, or receiving any service from Pace Sports Performance Inc. (“Pace”, “we”, “us”), you agree to these terms. If you are agreeing on behalf of a club, school or organisation, you confirm you have authority to bind that organisation.
If you do not agree, do not use the site or the services.
Accounts and access
Portal access is by emailed sign-in link or password, depending on your role. You are responsible for keeping access to your email account and your credentials secure, and for everything done through your account.
- Athletes see only their own record, results and reports.
- Team coaches and club administrators see only athletes within their own engagement.
- Pace staff and administrators have broader access strictly for delivering and supporting the service.
Do not share sign-in links, and tell us immediately at support@pace.fit if you think an account has been compromised. We may suspend an account where we reasonably suspect misuse.
What the services are
Pace provides field fitness testing, athlete and training-load monitoring, performance reporting, and physical development programming, delivered in person and through the Athlete Performance Portal.
The portal is a record of work performed and data collected. It is not a medical device, a diagnostic tool, or a substitute for assessment or treatment by a qualified healthcare professional. Results, reports and recommendations are coaching guidance based on the data available to us.
Fees and payment
- Prices are those published on our Programs page or set out in a written proposal, in Canadian dollars unless stated otherwise, exclusive of applicable taxes which are added at checkout or on invoice.
- Card payments are processed by Stripe. By submitting a payment you authorise us and Stripe to charge the amount shown, and you confirm you are authorised to use that payment method.
- Recurring programs and monthly team packages renew automatically for the stated term until cancelled. You authorise recurring charges at the stated interval until you cancel.
- Team engagements may instead be invoiced. Invoices are payable within 14 days unless the proposal says otherwise; overdue amounts may accrue interest at 1.5% per month and we may pause delivery until the account is current.
- If a payment fails, we may retry it and may suspend access until payment succeeds.
Cancellation and refunds
- You may cancel a recurring program or package at any time with 30 days' written notice to support@pace.fit. Cancellation takes effect at the end of the current paid period; we do not pro-rate part periods.
- Booked testing days and sessions cancelled with less than 48 hours' notice may be charged in full, as the slot and staff time are reserved for you.
- Fees for services already delivered — sessions run, testing completed, reports issued — are non-refundable.
- Nothing here limits rights you have under applicable consumer protection law.
Your obligations
- Give accurate information at sign-up and keep it current — testing benchmarks and programming depend on details like date of birth, sport, level and position.
- Where the participant is under the age of majority, a parent or legal guardian must consent before enrolment, testing or portal access. Clubs and schools that enrol athletes confirm they hold that consent.
- Disclose injuries, illnesses, medical conditions or limitations that could affect safe participation, before testing or training, and tell us promptly if they change.
- Obtain medical clearance where you have any reason to doubt fitness to participate.
- Follow reasonable safety instructions from Pace staff during any session or testing day, and provide a safe, suitable facility where the work happens on your premises.
Health, safety and assumption of risk
Physical testing and training carry inherent risks, including muscle strain, joint injury, falls, fainting, cardiac events and, in rare cases, serious injury or death. Maximal efforts such as sprint testing and Yo-Yo IR1 are physically demanding by design.
By participating, you — or the guardian consenting on an athlete’s behalf — acknowledge and voluntarily assume these risks. You confirm the participant is medically fit to take part and agree to stop and seek medical attention if pain, dizziness or distress occurs.
Nothing in Pace’s reports or programming is medical advice, and our guidance does not replace the instructions of a physician, physiotherapist or other clinician.
Intellectual property
Pace owns the site, its content, the report formats, testing batteries, benchmarking models, program templates and all associated intellectual property. Nothing here transfers ownership.
You keep ownership of your own underlying data. We grant you a personal, non-exclusive, non-transferable licence to use the reports and materials we produce for you, for your own training, coaching or recruitment purposes. You may not resell, republish, sublicense or redistribute them, or use them to build a competing service.
Athlete data and case studies
How we handle personal information is set out in our Privacy Policy, which forms part of these terms.
We use results in public case studies or marketing only in anonymised, non-identifying form, and only where the athlete — or their guardian — gave that optional consent during onboarding. That consent can be withdrawn at any time by emailing support@pace.fit.
Acceptable use
You agree not to:
- Access accounts, records or areas of the platform you are not authorised to use
- Scrape, crawl, bulk-download or reverse engineer any part of the site or portal
- Upload malicious code, or interfere with the availability or security of the service
- Submit false information, impersonate another person, or enrol an athlete without the required consent
- Use the service for any unlawful purpose, or to harass or endanger any participant
Third-party services
The service relies on third parties including cloud hosting, email delivery and Stripe for payments, and the site may link to external sites. We are not responsible for the content, availability or practices of third parties, and your use of their services may be subject to their own terms.
Disclaimers and limitation of liability
The site and portal are provided on an “as is” and “as available” basis. We do not warrant uninterrupted or error-free operation, and we do not guarantee any particular performance outcome, improvement, selection, scholarship or recruitment result.
To the maximum extent permitted by law, Pace is not liable for indirect, incidental, special, consequential or punitive damages, or for lost opportunity, lost revenue or loss of data. Our total aggregate liability arising out of or relating to the services is limited to the amount you paid to Pace in the 12 months before the event giving rise to the claim.
Nothing in these terms excludes or limits liability that cannot be excluded by law, including liability for death or personal injury caused by our negligence, or for fraud.
You agree to indemnify Pace against claims, losses and reasonable legal costs arising from your breach of these terms, your misuse of the service, or your failure to obtain required guardian consent.
Suspension and termination
You may stop using the service at any time and ask us to close your account. We may suspend or terminate access for breach of these terms, non-payment, or conduct that puts participants or the platform at risk — with notice where practical.
On termination, your portal access ends. Your records are retained and then deleted in line with the retention periods in the Privacy Policy, and you may request an export or earlier deletion by emailing support@pace.fit.
Governing law
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there. The courts of British Columbia have exclusive jurisdiction, and you submit to the venue of Kelowna, British Columbia, subject to any mandatory rights you have to bring proceedings in your place of residence.
General
We may update these terms as the services change; the effective date above reflects the current version, and continued use after a material change means acceptance. If any provision is found unenforceable, the rest remains in force. These terms, together with the Privacy Policy and any signed proposal, form the entire agreement between us. You may not assign your rights without our consent; we may assign ours in connection with a merger or sale of the business.
